These general terms and conditions of sale and use (hereinafter referred to as “GTC”) govern the relationship between the company Loïs Kedochim (hereinafter referred to as “Loïs Kedochim,” “we,” or “us”) and the users (hereinafter referred to as “you” or “your”) of the websites www.loiskedochim.com and www.loiskedochim.ch (hereinafter referred to as “the Site”).

Purpose and Scope

The purpose of this page is to define the conditions under which Loïs Kedochim sells and delivers products ordered on the Website, as well as the terms of use of the Website.

Products

The products sold on the Website comply with current Swiss legislation. The descriptions, photographs, and illustrations of the products presented on the Website are as accurate as possible, but cannot guarantee a perfect likeness to the physical product. If you have any questions about a product, please do not hesitate to contact us.

Prices

Product prices are indicated Prices are in Swiss francs (CHF) and include Swiss VAT. Delivery charges are not included and will be billed separately. Loïs Kedochim reserves the right to change its prices at any time, but products will be billed based on the rates in effect at the time of the order.

Ordering

Orders are placed online via the Website. To place an order, you must create an account and provide the required information. You are responsible for the accuracy of the information provided. The order is considered final after payment confirmation.

By placing an order for eyeglasses with corrective lenses on the Website, the Customer certifies:

– being over 18 years of age, or failing that, having the authorization of a guardian or curator if they are legally incapacitated.

– being in possession of a valid medical prescription for eyeglasses with corrective lenses. This prescription may be entered directly by the customer or sent as a prescription to LOIS KEDOCHIM (to process the order). As long as If LOIS KEDOCHIM does not receive the medical prescription, delivery will be suspended.

To place an order, the Customer can select one or more products and add them to their cart. The process of selecting eyeglasses is broken down into two additional steps and will be summarized in a quote:

– Step 1: Product selection

– Step 2: Lens selection from various options (non-prescription, single-vision, or progressive lenses), and various optional features (scratch-resistant, anti-reflective, anti-smudge, etc.),

– Step 3: Providing the prescription details (correction, pupillary distance, etc.) according to the various procedures. The customer acknowledges without limitation or reservation that, failing to provide a medical prescription less than three years old, they will not be eligible for reimbursement from the French National Health Insurance (Assurance Maladie) under the usual conditions.

– Step 4: Cart validation (order interface displaying the selected products) (the buyer).

The Company reserves the right to suspend or cancel any order fulfillment and/or delivery, regardless of its nature or stage of completion, in the event of non-payment or partial payment of any sum owed by the Customer to the Company, in the event of a payment incident, or in the event of fraud or attempted fraud related to the use of the website and the payment of an order.

Payment

Payment can be made by credit card, PayPal, or bank transfer. Payments are secured through our partner Stripe. In the case of payment by bank transfer, your order will be validated upon receipt of payment.

Delivery

Delivery is free worldwide, with the exception of the destinations listed on the website.

Products are delivered to the address you provided when placing your order. The maximum delivery time is 30 business days and depends on the product ordered and the delivery location. Loïs Kedochim cannot be held liable for delivery delays caused by events beyond its control.

Orders are delivered by Swiss Post and/or DHL and/or Chronopost within a maximum of 30 business days from the date the seller receives full payment, provided they have all the necessary information to fulfill the order. See the “Order” section.

However, certain products or order volumes may require a longer delivery time; this will be expressly indicated to the consumer during order confirmation.
Any delivery delay exceeding thirty days may result in the cancellation of the sale at the consumer’s initiative, upon simple written request sent by registered letter with acknowledgment of receipt. The customer will then be reimbursed for all sums paid at the time of the order. This clause does not apply if the delivery delay is due to a force majeure event beyond the Company’s control.

In such cases, the customer agrees not to take legal action against the website and its publisher and waives the right to cancel the sale as provided for in this article.

Apparent Defect

The customer agrees to verify that the product conforms to their order upon delivery. Any delivery error or apparent defect must be reported within 7 days of delivery. After this period, the product will be considered accepted by the customer, who will no longer be able to claim a delivery error or apparent defect.

Right of Withdrawal & Refund

You have 90 days from the date of purchase on the website to return your order. Products must be returned in their original packaging and in perfect condition.

The refund will be issued using the original payment method, unless the customer expressly agrees to another method of reimbursement.

To exercise this right, the Customer must inform the LOIS KEDOCHIM brand of their intention to withdraw by contacting Customer Service within 90 days of the Order at the following address: retina@loiskedochim.com

Return shipping costs are initially the Customer’s responsibility and will be reimbursed by Loïs Kedochim if the reimbursement conditions are met.

Warranty

All products sold on the Site are covered by a 2-year legal guarantee of conformity from the date of receipt.

Intellectual Property

The Site and its content are wholly owned by the Loïs Kedochim brand. Any legal entity or individual using its content without the written consent of the President of the Loïs Kedochim brand is liable to prosecution.

We have several manufacturing partners, and we collaborate with each of them to offer a unique product. However, this results in longer lead times and some variability. We therefore prefer to inform you now of our Achilles’ heel: the delivery time. However, you will be satisfied with everything else. This timeframe will be shortened and better controlled as the brand develops.

After the package has been shipped, the recipient is responsible for its proper receipt. It is their responsibility to contact the collection point if necessary.
